Right to Rest Breaks, Water, and Shade

Employees have the right to take regular rest breaks, access cool drinking water, and seek shade or air-conditioned areas to protect themselves from heat stress. These rights are necessary for maintaining health and safety in hot working environments:

  • Rest Breaks: Employees shall be allowed to take frequent breaks, especially during peak heat times. These breaks help to cool down the body, reduce the risk of heat-related illnesses, and maintain productivity.
  • Access to Water: Employers must provide ample supplies of cool, potable water throughout the worksite. Employees should have access to at least one quart (32 ounces) of water per hour to stay hydrated and prevent dehydration.
  • Shade and Cool Areas: Employers must ensure that shaded or air-conditioned areas are available for employees to rest during breaks. These areas should be easily accessible and provide a comfortable environment for cooling down.
