What is Hazardous Waste?
The EPA regulates hazardous waste under the Resource Conservation and Recovery Act (RCRA) . A waste is hazardous under RCRA when it is listed in the regulations or exhibits a hazardous-waste characteristic and is not excluded.

Solid Waste: EPA has specified at 40 CFR Part 261 a solid waste is hazardous if it is not excluded from regulation as a hazardous waste and meets any of the following conditions:
- exhibits any of the characteristics of a hazardous waste
- has been named as a hazardous waste and listed in the regulation
- is a mixture containing a listed hazardous waste and a nonhazardous solid waste
- is a waste derived from the treatment, storage, or disposal of listed hazardous waste
